Placement of an order on LK Technologies, Inc. website, or any other action made to secure a transaction for the sale of goods from LK Technologies, Inc., subjects Customer to the following Terms and Conditions. The Terms and Conditions are subject to change without prior notice. The Terms and Conditions posted on the site at the time Customer initially places or modifies an order will govern the order in question. No course of prior dealings between the parties and no usage of trade will be relevant to determine the meaning of these Terms and Conditions of sale or any purchase order or invoice related thereto.
These Terms and Conditions of sale constitute the entire agreement between Customer and LK Technologies, Inc. relating to the Terms and Conditions of sale of products on the website. The Terms and Conditions of sale are limited to those contained herein. Any additional or different terms in any forms delivered by Customer are hereby deemed to be material alterations and notice of objection to them and rejection of them is hereby given. Additional or different Terms and Conditions contained in any Customer issued purchase order will be null and void.
These Terms and Conditions and any sale of products or services hereunder will be governed by the laws of the state of Ohio, without regard to conflicts of laws rules. Any arbitration, enforcement of an arbitration or litigation will be brought exclusively in Cuyahoga County, Ohio, and Customer consents to the jurisdiction of the Federal and State courts located therein, submits to the jurisdiction thereof and waives the right to change venue. Customer further consents to the exercise of personal jurisdiction by any such court with respect to any such proceeding.
Except in the case of nonpayment, neither party may institute any action in any form arising out of these Terms and Conditions more than one (1) year after the cause of action has arisen.
Disclaimer of Warranty
Customer understands that LK Technologies, Inc. is not the manufacturer of the products purchased by Customer hereunder and the only warranties offered are those of the manufacturer, not LK Technologies, Inc. In purchasing the products, Customer is relying on the manufacturer's specifications only and is not relying on any statements or specifications in description, pictures or other illustrations representing the products that may be provided by LK Technologies, Inc. Please Note: LK Technologies, Inc. is not responsible for "exact" sizes - standard size tolerances apply. For all metals, plastics, and polycarbonates, a size tolerance of +/- 1/4 inch applies. For all window films and tapes, a size tolerance of +/- 1 inch applies. For all glass, a size tolerance of +/- 1/8" applies. All cuts have UNFINISHED edges.
LK Technologies Inc. disclaims all warranties including, but not limited to, express warranties and implied warranties of merchantability and fitness for a particular purpose. In some instances the product purchased may contain a manufacturer’s warranty. In such cases any repairs or replacements are to be decided and handled by the manufacturer solely as they see fit. LK Technologies Inc. will not be liable for any such repairs, replacements, costs of replacements or the merchandise itself. Nor will LK Technologies Inc. be responsible for any costs pertaining to the shipping and handling of any such merchandise. LK Technologies Inc.’s sole responsibility in such cases where the manufacturer has provided a warranty will be to contact the manufacturer on Customer’s behalf. Once the manufacturer is notified, LK Technologies, Inc. is released of all other duties.
Limitation of Liability
LK Technologies, Inc. will not be liable for lost profits, loss of business or any consequential, special, indirect or punitive damages, even if LK Technologies, Inc. has been made aware of the possibility of such claims or damages, or for any claim by any third party against LK Technologies, Inc. or its Customer.
In all circumstances, LK Technologies, Inc.'s maximum liability is limited to the purchase price of the products sold. LK Technologies, Inc. shall not, under any circumstances, be liable for damage to possessions or for any injury. LK Technologies, Inc. will not be liable, for any reason, upon any claim or action in contract, tort, indemnity, or contribution, or other claims relating to the products it sells which exceeds this liability limit.
LK Technologies, Inc. assumes no responsibility for defect, or damage of products which are used in a manner other than the intended purpose.
Products are represented according to the descriptions and specifications provided by their manufacturer. Adjustments to product description can be made by LK Technologies, Inc. for reasons including, but not limited to, product modifications, errors in advertisements and other extenuating circumstances. LK Technologies, Inc. does not guarantee or provide warranty for any of the content displayed on this website. While it is LK Technologies, Inc. goal to keep the information on the website as precise as possible, the website may be subject to technical and contextual falsities. This includes, but is not limited to, visual representation of products. The color presented on Customer’s computer screen may not be the true color of the product. Due to variations in monitors and color settings, what Customer sees will vary from one screen to another.
Custom Order Items
Custom Items are made-to-order per the specifications provided by the Customer. It is the sole responsibility of the Customer to provide accurate details and measurements regarding Custom Items. A signed confirmation verifying that all information is accurate and correct is requested by LK Technologies, Inc. (available by fax or email from LK Technologies, Inc.) prior to acceptance of an order. Custom Items cannot be returned or exchanged for refund or credit; all sales are final. LK Technologies, Inc. assumes no responsibility, nor liability, for Custom Order Items, as all details are provided by the Customer and forwarded to manufacturing.
Prices are subject to change. Adjustments to prices can be made by LK Technologies, Inc. for reasons including, but not limited to manufacturer price changes, changing market conditions, advertisement errors and other extenuating circumstances. LK Technologies will not adjust price of any product or service purchased prior to price adjustment. LK Technologies, Inc. reserves the right to ship a replacement item without notice to Customer, providing the replacement item is of an equal or greater price than the item replaced, and the specifications of the replacement item are equal to or greater than of the original item ordered.
No coupon may be used in conjunction with any other offer. One coupon per order. Coupons are valid for online orders only – coupons are not applicable to orders placed via phone. Coupons are non-transferable. Coupons are not valid with any instant savings (free shipping, discounted items) offer. Coupons have no cash value. All coupons must be used at time of order. Tax (where applicable), processing and service fees, and shipping are not included in coupon savings. Void where prohibited. To qualify for discount, entire order must be shipping to single address. Coupons not valid on any special order item – not all special order items are marked as such. “Special Order” status is left to the discretion of coupon issuer (LK Technologies, Inc.)
Orders are not binding upon LK Technologies, Inc. until accepted by LK Technologies, Inc. LK Technologies, Inc. reserves the right to cancel any order for any reason. Any order is subject to product availability. Therefore, LK Technologies cannot guarantee that it will be able to fulfill any order. All products are considered to be In-Stock, unless otherwise stated as Special or Custom Order; however there may be a lead-time, dependant upon manufacturer availability. Customer must claim any exemption from tax at the time of purchase and provide the necessary supporting documentation prior to the order being processed.
Customer consents to receiving electronic records pertaining to his order, which may be provided via a web browser or e-mail application connected to the Internet. Individual consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting LK Technologies, Inc. at the address provided above.
Customer agrees to pay the total purchase price for the products plus sales tax, if applicable, and shipping charges, including shipping charges that are billed to LK Technologies, Inc. as a result of using Customer's carrier account number. Terms of payment are within LK Technologies, Inc. sole discretion. If Net Terms were extended to Customer, invoices are due and payable within the time period specified on the invoice, counted from the date of invoice.
LK Technologies, Inc. will process any order received within 24 business hours after it was placed. Processing includes verifying any information that may be incorrect and charging the credit card. Weekends and holidays may extend this timeframe; LK Technologies, Inc. is closed Saturday and Sunday.
For items that are out of stock, you will be notified of your order status within 24 to 48 hours (excluding weekends and holidays).
LK Technologies, Inc. will ship any order within approximately three to five business days after it is processed. An e-mail with the tracking number will be sent to the email address provided by the Customer on the order receipt, upon the shipment of the order.
LK Technologies, Inc. uses US Postal Service, UPS or FedEx as carriers. It is at the discretion of LK Technologies, Inc. as to the carrier to use, depending on the size of the package, type of product, as well as destination. If any of the carriers do not delivery to the shipping address provided by Customer, or the Customer has a preference as to the method of shipping, it is Customer's responsibility to note in the comment area as to the carrier preference.
Second Day and Next Day Air shipping is available; however not all items are eligible for Expedited Shipping. It is at the discretion of LK Technologies, Inc. to determine whether an item is able to ship by expedited service. Hazardous and Flammable materials must be shipped by Ground Transportation only. Second Day and Next Day service refers to the next business day, not the next calendar day. Orders shipped via Second Day on Thursday, or Next Day on Friday, will be delivered on the following Monday. Saturday Delivery can be requested for an additional fee, to be determined at time of the order.
If for any reason the shipment of an order is delayed Customer will be notified about it via e-mail.
If an order is needed within a specific time frame, the Customer should contact LK Technologies, Inc. at 1-888-663-9830 or customerservice@GlassVanguard.com prior to order processing.
In the rare instance that a package is delayed or lost-in-transit:
Domestic packages shipped by USPS Priority Mail, USPS First Class, or USPS Parcel Post require a waiting period of 21 days from the date-of-shipment to be considered “lost in transit”. If a package is in-transit for longer than 10 business days from ship-date, and the customer would like the package reshipped before the 21-day period, a second order will need to be placed. The Customer can then choose to keep, or return, the original package if/when it is delivered. If the customer would like a replacement order shipped after the 21-day mark, the order will be reshipped free of charge.
International packages shipped by USPS Priority Mail International require a waiting period of 45 days from the date-of-shipment to be considered “lost in transit”. If a package is in-transit for longer than 15 business days from ship-date, and the customer would like the package reshipped, a second order will need to be placed. If the customer would like a replacement order shipped after the 45-day mark, the order will be reshipped free of charge, as long as a Lost Package Letter is provided to LK Technologies, Inc. by the Customer.
Free Shipping Offers
Free Shipping Offers apply only to products shipped within 48 contiguous United States. Eligible for Free Shipping Offer product is identified as such on the web page from which it is purchased. Free Shipping Offer does not apply to any other product not identified as a subject to such offer. In the event products offered for Free Shipping and products subject to regular shipping charges are purchased on the same order, the freight charge will appear on the invoice. It will reflect the shipping charge for the product subject to regular shipping charges only, while the product offered for Free Shipping will not incur any shipping charges. If a product originally shipped under Free Shipping Offer is returned for preference, Customer is responsible for actual shipping charges incurred by LK Technologies, Inc. All returns on orders placed under "Free Shipping" offers will incur shipping charge deduction in addition to standard restocking fees.
LK Technologies, Inc. will not be responsible for any delays in delivery which result from any circumstances beyond its control, including without limitation, product unavailability, carrier delays, delays due to fire, severe weather conditions, failure of power, labor problems, acts of war, terrorism, general insurrection, acts of God or acts of any government or agency.
If a shipment is not received, it must be reported within 20 days of the date the shipment left LK Technologies, Inc.'s facilities. Any missing shipment reported after this amount of time has passed will not be investigated, nor will LK Technologies, Inc. be held liable for the shipment or any costs directly or indirectly associated. Once notified of a missing shipment, LK Technologies, Inc. will contact the carrier and open an investigation in attempt to trace the package. LK Technologies, Inc. will handle all missing shipments in accordance with the findings of the carrier investigation. LK Technologies, Inc. does not require a signature for delivery. If the Customer wishes a delivery with required signature, LK Technologies, Inc. must be informed of this at the time of the order. Signature fees may apply.
It is Customer's responsibility to provide LK Technologies, Inc. with a deliverable shipping address. If an order is returned to LK Technologies, Inc. because the shipping address provided by the Customer was deemed "undeliverable" by a carrier, an additional shipping charge will be applied to ship the package to the Customer again. If the Customer chooses not to have the package reshipped, the order will be treated as a standard return as described in these Terms and Conditions, and the original shipping charges will not be refunded. Any fees imposed by a carrier for corrections of an incomplete or wrong shipping address provided by Customer will entail a charge of $12.00, and/or any applicable shipping charges, to the credit card provided. It is the Customer's responsibility to make sure the correct billing and shipping addresses have been provided at the time the order is placed, including necessary suite, building, or apartment numbers. Refusal of delivery will not prevent original shipping charges, return shipping fees or any restocking fees from being deducted from a refund. Refusal of a package is treated as a Standard Return, as outlined below.
If a Customer would like to cancel an order, the Customer must e-mail a request, along with the order number, to customerservice@GlassVanguard.com, or call 1-888-663-9830. A 5% cancellation fee will apply if the order needs to be cancelled the next business day after it was placed. Every attempt will be made to cancel an order upon each request. However, LK Technologies, Inc. cannot cancel an order once it has been shipped. If the Customer would like to cancel an order after the order has been shipped, standard Return procedures, as outlined below, will apply. Custom and Special Order Items cannot be cancelled once the order has been placed with the manufacturer.
All returns must be authorized prior to shipment. To obtain a return authorization LK Technologies, Inc. must be contacted via e-mail at customerservice@GlassVanguard.com or by phone at 1-888-663-9830. The reason for the return request must be specified. All return requests are permitted within 15 (fifteen) calendar days from the date of receipt of merchandise. Any return must be shipped within 5 (five) business days from the day it was authorized. Returned merchandise will be inspected upon receipt and accepted by LK Technologies, Inc. only if the items are in resalable condition. Product packaging must be in like-new condition; products will not be accepted for return if the packaging is cut, torn, written on, or otherwise damaged. Packaging must be in resalable condition in order to receive a refund. All items included with the original shipment must be present with the returned merchandise; this includes, but is not limited to: screws, fasteners, gaskets, instructions, etc. Returns that are missing components, have severely damaged packaging, or have in any way been damaged, deformed, or altered cannot be credited. Shipping and handling fees are non- refundable. A 15% restocking fee applies to all returns; if you would like to place a new order, of equal or greater value, the restocking fee may be waived, if within the 15 (fifteen) day return period. If you would like to make a return and place a new order, please contact LK Technologies, Inc. by phone at 1-888-663-9830 and speak with a Customer Service Representative. All return items must be shipped prepaid and insured and contain the following information: return authorization number, packing list of items returned. Return Authorization Number must be written on the box or enclosed with the product. All returns on orders placed under Free Shipping offers will incur shipping charge deduction in addition to standard restocking fees. Any items cut to size, or altered in any way, may not be returned or exchanged for refund or credit. Custom and Special Order Items are non-returnable; all sales are final. Tools and safety wear items, such as, but not limited to, coveralls, aprons, vests and jackets may not be returned and are non-refundable.
For product damages, LK Technologies, Inc. must be contacted by phone (1-888-663-9830) or at customerservice@GlassVanguard.com within three (3) business days of receipt of shipment. LK Technologies, Inc. may request photo documentation of damaged or defective item(s) in order to expedite resolution. Product must be in its original form and have all original packaging; product must not be used, cut, or altered in any way, if damage or defect appears to be present. Resolution regarding damaged or defective product(s) will be pending inspection; inspections may be performed by LK Technologies, Inc. or by the product manufacturer. Pending the results of the inspection, replacement, full refund, or partial credit may be issued.
If a product is claimed to be damaged or defective and is picked up by LK Technologies, Inc. or product manufacturer, to be inspected, and is determined to be of satisfactory quality, the item will be treated as a standard return, and also incur the shipping charges to pick-up and/or reship the product.
If the package appears to have been damaged during transit, Customer must keep all packaging, including packing materials, as well as any interior or exterior boxes. LK Technologies, Inc. will file a claim with the carrier; the carrier may choose to have the merchandise inspected by a carrier representative or picked up and returned to LK Technologies, Inc. Upon receiving the results of inspection or upon return of the damaged merchandise, a replacement order will be shipped, or a full refund will be issued to the Customer.
International shipments which have incurred damage while in transit will require photo documentation, as well as a Customer Letter (available from LK Technologies, Inc.) in order to process the International Claim Paperwork. Once the proper documentation has been received by LK Technologies, Inc., a replacement order will be shipped, or a refund will be issued to the Customer.
Missing, Mislabeled, or Incorrect Item(s)
In the very unlikely situation of a missing, mislabeled, or incorrect product, LK Technologies, Inc. will need to be able to investigate the case. For this purpose: all missing, mislabeled, or incorrect items must be reported to customerservice@GlassVanguard.com or 1-888-663-9830 within three (3) business days of receipt of shipment. No instance of missing, mislabeled, or incorrect product(s) will be investigated, and LK Technologies, Inc. will not be able to ship any missing or replace any mislabeled or incorrect product(s) reported after this time. LK Technologies, Inc. may request photo documentation from the Customer in an instance of a mislabeled or incorrect item. LK Technologies, Inc. will not issue any reimbursements for missing items purchased by the Customer. If an item is missing from the order, the Customer must contact LK Technologies, Inc. directly to resolve the issue.
Any product sold or distributed under these Terms and Conditions of sale may not be exported or re-exported to countries, entities and persons that are ineligible under United States law to receive United States commodities, technology and/or software. In addition, manufacturers' warranties for exported products may vary or may be null and void for products exported outside the United States.
LK Technologies, Inc. has designed its online store to give you options concerning the privacy of your credit card information, name, address, e-mail and any other information you provide us. LK Technologies, Inc. is committed to data security with respect to information collected on our site. In addition to the industry standard security measures available through your browser called SSL encryption, LK Technologies, Inc. has made a practice to call Customer in the event of potential problem with the purchase. Also, Customer may always contact a sales representative over the telephone at 1-888-663-9830, in case Customer does not want to provide the credit card information online.
LK Technologies, Inc. strongly encourages Customers to use their billing address as a shipping destination to minimize risk of fraud, however unlikely a scenario it may seem.
For protection of our Customers, LK Technologies, Inc. might choose to ship to the verified billing address or authorized shipping address registered with Customer's credit card issuer. Authorized shipping address can be obtained upon contact of the credit card issuer by calling the toll-free number on the back of the credit card. Credit card issuer registers alternative (shipping) address upon Customer's authorization in addition to existing billing address for internet placed orders deliveries.

LK Technologies, Inc. wants to help Customers quickly find information on the website, make navigation more intuitive and be able to share the information with friends, relatives and neighbors.
